BeApex Terms of Service

1.1 You must be at least 13 years old to create or use a BeApex account. If you are under the age of majority in your jurisdiction, you represent that a parent or legal guardian has reviewed and accepted these Terms on your behalf.

1.2 You agree to provide accurate and complete account information and to keep that information current.

1.3 You are responsible for all activity under your account and for maintaining account credential security.

2.1 BeApex is a skill-based gaming and loyalty rewards platform. Gameplay outcomes and seasonal ranking progression are designed around user engagement, strategy, and skill mechanics.

2.2 BeApex does not offer real-money wagering, betting, casino gaming, or gambling services.

2.3 You do not stake, risk, or wager money in BeApex gameplay. All in-app currencies are virtual and have no cash value.

3.1 BeApex includes a virtual pet progression system where users earn Gems through eligible activity, use Gems to grow a Panther, and collect Stars generated over time.

3.2 Stars affect leaderboard rankings in recurring competitive periods called Battle Seasons.

3.3 Devfing may modify season duration, ranking logic, scoring formulas, balancing, rewards, or related mechanics at any time to maintain fairness, app quality, or compliance.

4.1 BeApex may use Gems, Stars, and Credits. These are virtual promotional units only and are not money, legal tender, bank deposits, or stored value instruments.

4.2 Virtual currencies: (a) have no cash value; (b) cannot be redeemed for cash; (c) cannot be transferred, sold, or exchanged outside authorized in-app features; and (d) may expire or be adjusted by Devfing.

4.3 Credits may be redeemable for eligible promotional rewards (such as gift cards or vouchers) subject to availability, verification, anti-fraud checks, and provider restrictions.

5.1 BeApex may offer optional in-app purchases (including future boosters) through Apple App Store and Google Play billing systems only.

5.2 Purchase terms, taxes, subscription controls, and refund rights are governed by the applicable platform terms, including Apple and Google billing policies.

5.3 Devfing may change pricing, inventory, availability, or booster effects at any time, subject to applicable law.

6.1 BeApex may display ads and may allow users to voluntarily view rewarded advertisements to receive promotional bonuses.

6.2 BeApex may integrate third-party offerwall providers. Offer completion tracking, qualification, and reward decisions may be made by those providers, and provider rules apply in addition to these Terms.

6.3 Devfing is not liable for third-party ad or offerwall outages, task tracking failures, delayed reward events, rejections, policy violations by providers, or provider-side account restrictions.

8.1 Referral incentives are promotional and conditional. Devfing may define eligibility criteria, payout timing, anti-fraud checks, and campaign limits.

8.2 Devfing may change, pause, or terminate referral programs at any time.

9.1 BeApex is provided on an "as available" basis. We do not guarantee uninterrupted operation, error-free gameplay, continuous network connectivity, or uninterrupted reward accrual.

9.2 Devfing is not liable for losses resulting from network interruptions, mobile carrier issues, device-level failures, platform downtime, maintenance, force majeure events, or third-party service failures.

10.1 We may suspend, restrict, or terminate access where we reasonably believe there is risk of fraud, abuse, non-compliance, legal exposure, or platform integrity harm.

10.2 On suspension or termination, Devfing may remove or invalidate affected virtual balances, leaderboard positions, pending redemptions, and referral credits tied to abuse or ineligible activity.

11.1 To the maximum extent permitted by law, BeApex is provided without warranties of merchantability, fitness for a particular purpose, or non-infringement.

11.2 To the maximum extent permitted by law, Devfing is not liable for indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, goodwill, virtual rewards, or expected promotional value.

11.3 In jurisdictions that allow liability caps, Devfing's aggregate liability will not exceed the amount you paid to Devfing for BeApex in the 12 months preceding the event giving rise to a claim.

12.1 These Terms are governed by the laws of the United States, without regard to conflict-of-law principles.

12.2 Unless otherwise required by applicable consumer law, disputes shall be resolved in competent courts located in the United States.

13.1 We may update these Terms from time to time. Material changes may be communicated in-app or via website updates. Continued use after changes become effective constitutes acceptance.
